Massachusetts head-on collision kills 1

11/9/2013

One person was killed and another injured in a head-on collision in Deerfield Nov. 4. The car accidenttook place at 520 River Road minutes after 3:00 p.m. According to investigators, the crash trapped both drivers inside their vehicles. One driver, an 83-year-old Montague woman, was pronounced dead at the scene, and the other, a 19-year-old male, was taken to the hospital for treatment of non-life-threatening injuries.

The accident closed River Road for several hours so that crews could clear the scene. Several agencies are working together on the accident investigation, including the Massachusetts State Police Collision Analysis and Reconstruction Section, the Massachusetts Police Detectives Unit and the Deerfield Police Department.

When an accident results in serious injuries or death, law enforcement may perform an accident reconstruction. The process helps investigators determine what might have caused a collision. A personal injury lawyer may be able to use the investigators’ accident reconstruction report to support a wrongful death claim.

If the results of the report make it clear who was at fault in an accident, it may be possible to settle the matter with the insurance company outside of court. On the other hand, if the insurance company tries to deny the claim or offers a meager settlement, the case may be brought to civil court.

In court, the accident reconstruction experts may present evidence and explain accident events to the jury. Once the jury has reviewed all of the evidence and listened to witnesses and closing arguments, it will deliberate and render a decision. If the case is compelling, the jury may award substantial damages to the plaintiffs.
