The Motor Vehicle Crash Operator Report

If you are involved in a car crash in the Commonwealth of Massachusetts, you most likely need to complete a Motor Vehicle Crash Operator Report. M.G.L. Chapter 90, Section 26 requires a person who was operating a motor vehicle involved in a crash in which (i) any person was killed or (ii) injured or (iii) in which there was damage in excess of $1,000 to any one vehicle or other property, to complete and file a Crash Operator Report with the Registrar within five (5) days after such crash (unless the person is physically incapable of doing so due to incapacity). Failure to comply with this Massachusetts statute may result in the vehicle operator’s motor vehicle license being suspended or revoked.

Car Accident Details

Completing the Massachusetts Crash Operator Report requires information that you hopefully obtained at the scene of the crash. You may have been transported from the scene of the crash in an emergency vehicle. If that is the case, then obtaining the information of the other driver and vehicle may require contacting the police department that responded to the crash.

Generally, the information required to completed the Motor Vehicle Crash Operator Report consists of:

  • Crash location
  • Your driver’s license
  • The vehicle you were operating
  • Any passengers in the vehicle you were operating
  • The other vehicle(s) involved in the crash
  • A diagram of the crash
  • Witness information
  • Description of what happened in the crash

 

How to Submit Your Accident Report

Once completed, the Motor Vehicle Crash Operator Report needs to be mailed to the police department that responded to the crash, or if no police responded, to the police department for the city or town that the crash occurred. The Motor Vehicle Crash Operator Report also need to be mailed to the Massachusetts Registry of Motor Vehicles and your insurance company.
